This Addendum governs your use of the Foreplay API and MCP server. It applies from the moment you create an API key or make an API call, and forms part of the Foreplay Terms of Service.
"API Data" means the advertising data and associated metadata returned to you by the Foreplay API or MCP server.
Subject to this Addendum and payment of applicable fees, Foreplay grants you a non-exclusive, non-transferable, revocable licence, for the term of your subscription, to access the API and use API Data — including within a product or service you operate for your own customers.
This is an express exception to Section 2 of the Terms of Service, which states that the Services are offered for your use and not for the benefit of any third party. That restriction does not apply to API Data used as permitted by this Addendum.
Within your product you may display ad copy, transcripts, metadata and Foreplay's derived fields to your authenticated users; process API Data using your own or third-party AI systems; and create analysis, classifications and summaries from it. You own the analysis you produce. Foreplay claims no rights in it.
Your customers must access API Data only through your product. You may not issue them API keys or give them direct API access.

You may cache the text and metadata we return — ad copy, transcripts, derived fields — for up to 30 days. Media is different: serve images and video from the URLs we provide rather than copying them into your own storage or CDN.
On termination, you may retain the analysis you have produced. Delete raw API Data within 30 days.
API Data describes advertisements created and published by third parties. Foreplay does not own those advertisements and grants you no rights in any advertiser's trademarks, copyrights, creative or brand.
API Data is provided as-is. You are responsible for determining whether your use of any advertisement is lawful in your jurisdiction, and for that use. Foreplay makes no representation or warranty that API Data may be used for any particular purpose. Sections 16 and 18 of the Terms of Service apply to API Data.
This Addendum supplements and is incorporated into the Terms of Service. Where the two conflict in relation to the API, MCP or API Data, this Addendum governs. All other provisions of the Terms of Service continue to apply.
Bulk data exports and data feeds are not covered by this Addendum and require a separate written agreement.
